preacherman, sorry to hear about you getting burned, and I hope this all works out for you. I know for a fact that you are a stand-up person to deal with!! With Stroker leaving a posts on the forum less than a month ago and not getting in-touch with you to get some resolution to the problem that is not a good sign on wanting to correct the problem... Well...I'm going to take it in the shorts on this one.
I talked to Paypal again tonight and finally got some straight answers.
Stroker used someone else's credit card or checking account and withdrew
money from it fraudulently. That's the money he used to pay me. When
the actual "owner" of the account found out...they filed a claim with Paypal
indicating that they had never bought an amp...which was true. They didn't
know he was using their account.
Paypal has paid the person who lost the money back and expects me to make
up the money to them because I did not use "seller" protection. They indicated that
they are in the process of "going after" Stroker for the money...but for the time being
I am on the hook. Avoid Shaun Garrity at all costs...he is a thief, a scammer and a
completely dishonest man.
I'm done with this...life is to short to let idiots take away your joy.

By reporting the info to PayPal ( Name, addy, phone, etc.) they will go after Stroker for fraud, identity theft, etc. It will not be about the amp legality it will be about his illegal activities. Since it was an interstate transaction, it may be Federal. So give PayPal everything you have in him and let them have at it.
As for the forum, banning is most likely but we want to try to contact him again to make this right. After this transaction I cant see him being a member anymore.

And it's not Preacherman that will be the one prosecuting the fraud, it would be PayPal, and / or the FBI since he used fraudulent credit / debit information across state lines. It is out of Preacherman's hands by a LONG shot...

I've had some ebay dealings and so forth, and for the most part Paypal is a monetary pay system that just doesn't work. And when there is a dispute, forget it, it drags on and on with no resolve.
I only take personal checks or money orders. I don't ship until after the check clears the bank. I use to ship right away, but I soon learned not everybody is a square shooter and you need to protect yourself.
Ditch paypal, as I did. I haven't had a problem since. You have to realize that they have to have some sort of recovery system because there are plenty of scammers on ebay. It's unfortunate, but the truth. Paypal should shut down because it's totally useless. In the end, it protects you from nothing............
For a payment system, I personally found that a credit card that offers online buyer protection is the best to use for buying. If you get ripped off, one phone call to the credit card company and you have your moey back!

as someone mentioned already paypal refuses to stand behind its protection policy because the transaction was done with an unverified address. that usually means the address on the credit card used was not the same address stroker has on his paypal file. paypal has reminders on the auction pages at ebay for paypal users to be verified and even confirmed (two different stages) to be able to have paypal protection at your disposal. (so you don't get burned). stroker has a paypal account and strokers address is a different one from the address of the card used. whether stroker and the card owner were in cahoots or not is another consideration. preacherman if it was me I'd accuse both stroker and the joker (pun intended) for trying to cheat the system. I wonder if the bank the card is attached to prosecuting stroker for theft. How does one get away with using someones' credit card ? answer. two ways...either by theft or cooperation. bust both their **Censored**'es

This kind of deal makes me have second thoughts about stroker's other bad? deals!

I wonder if preacherman could file a small claims court case in his district since he is the victim. That would make stroker have to go to that court and if it's out of state and he doesn't show preacher wins hands down. Worth a look see.

preacherman would have to travel to strokers area to file a claim because there is no law that can force stroker to travel to preachermans area. I got burned by a guitar builder in san diego and learned that lesson first-hand. What I would do is find out if the person whose card was used by stroker prosecuted stroker for theft and pressure paypal to pay up or press charges against the card owner and stroker. Since paypal seems to be in every state he can bring them into small claims.
